A court case I will never forget

Three years of litigation against an insurer's refusal to pay under a life insurance policy, ending with a family's loan being repaid in full.

The story

A few years ago, I was approached by the father and the grandmother of two young children who had lost their mother after a long illness. Besides the heavy loss, the family had to deal with a serious financial problem. The mother had taken out a consumer loan secured by life insurance in favour of the lender. After her death, the insurer refused to pay the sum insured, relying on the deceased's illness and on a contractual clause which, in its view, excluded its liability.

As a result, the loan remained unpaid and continued to weigh on the family.

The insurer's refusal was challenged in court

After reviewing the documents and the grounds for the refusal, I concluded that there were legal arguments to challenge it. A complex court dispute lay ahead, requiring an analysis of the terms of the insurance contract, the applicable legal provisions and the evidence on the grounds for the refusal.

Three years of court proceedings followed.

In the end, the court upheld the claim and the insurers were ordered to pay the sum insured. As a result, the loan was repaid in full.

This was the most important practical outcome of the case — after the loss of the mother, the family no longer had to carry the financial burden of the loan.

Why this case has stayed so important to me

In legal practice there are cases you remember not only for the legal issues or the court result. You remember them because of the people.

This case was one of them. Three years of litigation ended with the family's loan being repaid in full. But my satisfaction with this result was not only professional. It mattered to me that I was able to help people who had already suffered a heavy loss and needed not only legal protection, but also understanding and support.

After the case ended, I received words of gratitude that I will remember all my life. They reminded me that sometimes the greatest satisfaction in the legal profession is not the case won, but what the result means for people's lives.

When can an insurer's refusal be challenged?

I am telling this story because many people accept an insurer's refusal to pay as final. That is not always so. An insurance company's refusal is subject to legal assessment and, where there are grounds, it can be challenged in court.

It is particularly important to check:

  • The terms of the insurance contract concluded.
  • The specific grounds the insurer relies on.
  • Whether the clauses excluding insurance cover apply and how they operate.
  • The evidence gathered and whether the refusal complies with the law.

Every case has its own features and requires an individual legal analysis. A refusal does not necessarily mean that the right to insurance compensation does not exist.

Legal protection when an insurance claim is refused

If you have received a refusal from an insurer, including under life insurance taken out in connection with a bank loan, it is important to review the contract, the grounds for the refusal and the options for legal protection.

A timely consultation with a lawyer can help you establish whether the refusal is justified and what action can be taken. Sometimes there is much more than money behind a court case.
